Here’s a mid-March check-in blog on what’s been going on:
The 2024 WYOMING State Legislative Session is DONE
Ten anti-LGBTQ+ bills were defeated.
Two passed the legislature. One has been signed by the Governor, one has been sent to the Governor for signing.
YOU CAN STILL SPEAK OUT.
SF 0009 – has passed the Wyoming State Legislature and has been sent to the Governor for signing. This is an adolescent care ban. You can call Governor Gordon at (307) 777-7434 or send a message.
SF 009 – has been signed into law. This is a forced outing in schools bill and goes into effect on July 1st, 2024.
The 2024 FLORIDA State legislative session is done.
Of 22 anti LGBTQ+ bills introduced, one was passed (HB 1291 Stop WOKE Teacher Training,) two had problematic wording removed, and the rest failed. The legislature also passed a PEP Access bill!
We are still awaiting Judge Hinkle’s ruling from the December, 2023 trial of 254.
The 2024 UTAH State legislative session is done.
Three bills passed:
HB 157 – removes parental or guardian’s approval or disapproval of a child’s gender identity from consideration in custody decisions. This bill has been sent to the Governor.
HB 261 – passed into law and signed by the Governor. Anti-DEI (Diversity, Equity, Inclusion) bill prohibiting training for educational employees or any educational activities.
SB 150 – passed and sent to the Governor. It prohibits compelling any person to “act in a manner substantially motivated by a sincerely held religious belief.” Intended to let people refuse to acknowledge LGBTQ+ people. May come back to bite them in their butts.
HB 257 – passed into law and signed by the Governor. This is the bathroom bill. See the ACLU/Equality Utah write-up:
HB 316 – Passed and sent to the Governor for signing. Requires sex-segregated housing for incarcerated people.
HB 396 – Passed and sent to the Governor for signing. Protects religious speech in the workplace. The thing about religious freedom bills is that they have to go all ways.
An employer may not discharge, demote, terminate, or refuse to hire any person, or
retaliate against, harass, or discriminate in matters of compensation or in terms,
privileges, and conditions of employment against any person otherwise qualified, for
lawful expression or expressive activity outside of the workplace regarding the person’s
religious, political, or personal convictions, including convictions about marriage,
family, or sexuality, unless the expression or expressive activity is in direct conflict with
the essential business-related interests of the employer.
The 2024 WASHINGTON State Legislative Session is DONE
No anti- LGBTQ+ bills were passed. Yay!
The Keep Our Care Act, which would protect access to care after hospital or clinic mergers, passed the Senate, but did not progress in the House.
State Legislatures That Are Still Going
Alaska
The 2023 – 2024 Alaska State Legislature is in session for 90 to 121 days.
This year, Day 90 is April 14th. Day 121 is May 15th.
The ACLU is tracking seven bills in Alaska. They do not appear to be very active.
HB 183 – a school sports ban will be heard in the Education committee on 3/15 at 8am. Public testimony is invited. You can message your legislators via the Public Opinion Message System. The Legislative Information Office Directory can help you navigate attending the teleconference hearing.
HB 338 – extends the statutes of limitations on liability for gender care on minors. Committee hearings on this bill have been canceled twice. No additional hearing is currently scheduled. The ACLU has an email action to send a message to the House Judiciary Committee.
HB 382 – outing in schools. This bill was referred to the Education Committee on 2/20. Is not currently scheduled for a hearing.
HB 174 – prohibits public funds being used to further a “social, political, or ideological interest.” Has been heard in committed and held.
California
No bills are being tracked by the ACLU.
Hawaii
The Hawaii State legislative session is active until May 3rd.
The ACLU is tracking several bills in Hawaii, but none are expected to pass.
We’re supporting and advocating for HB 2079, which will allow telehealth prescribing of testosterone and make Hawaii a shield state. HB 2079 has passed the House and been sent to the Senate, where it has passed its first reading.
Idaho
The Idaho State legislative session is active until March 22nd. it isn’t anymore. Idaho’s adjournment day was targeted to be March 22nd, but session is still active (as of March 28th.)
The ACLU is tracking 12 bills in Idaho.
H 668 and H 520 are healthcare bills.
H 668 prohibits public funds being used for gender affirming care. This bill has passed the House and is being sent to the Senate.
H 520 also prohibits public funds from being used for gender affirming care. This bill is currently in the Judiciary Committee – it may have been shelved, as H 668 progressed.
There are also school and religious exemption bills that are advancing in the legislature.
Montana
There is no 2024 Montana State Legislative session.
