State Updates: for our own mental health and productivity, we can’t provide updates on all discriminatory legislation in the states we operate in. We will strive to provide updates on legislation that directly affect our ability to provide care, and we encourage you to support the fine folks who are providing more detailed local legislative updates. We would also love to know your information sources, especially for local actions.

CALIFORNIA – Equality California has not yet updated their legislation page to include 2025 bills. They do have a Take Action page
FLORIDA – Equality Florida does not have a legislation tracker, but does have frequent action alerts. You can subscribe to their mailing list at https://www.eqfl.org/stay-touch.
HAWAI’I – Stonewall Caucus of the Democratic Party of Hawai’i has a Take Action page and a Legislation page.
IDAHO – ACLU Idaho has a legislation tracker and a Take Action page.

ON HIATUS
February 20th Federal Updates:
Two new federal lawsuits challenging the federal administration’s executive order erasing trans, nonbinary, and gender diverse people from recognition:
Lamda Legal, along with the San Francisco AIDS Alliance, the Los Angeles LGBT Center, the GLBT Historical Society, the San Francisco Community Health Center, Prisma Community, Care, the NYC LGBT Community Center, the Bradbury-Sullivan Community Center, Baltimore Safe Haven, and FORGE, challenged executive orders 14168, 14151, and 14173 which stop federal funding going to programs or grantees that embrace DEIA (diversity, equity, inclusion, and accessibility). The lawsuit is San Francisco AIDS Foundation v. Trump, and was filed in the Northern District of California on the basis that the executive orders violate the First Amendment right to free speech, the Fifth Amendment’s due process clause, and the Fourteenth Amendment’s Equal Protection Clause. The suit also argues that the executive orders violate the Administrative Procedures Act.
Lambda Legal, in conjunction with the Legal Defense Fund, also filed another lawsuit on behalf of the AIDS Foundation Chicago, the National Urban League, and the National Fair Housing Alliance challenging the same executive orders.

February 18th State Updates
MONTANA:
HB121 – a bathroom ban bill passed both chambers and has been sent to the governor to sign.
SB218 passed the Montana Senate and was sent to the Montana House. This bill creates excessive requirements for liability coverage specifically for gender affirming care.
HB400– an intentional misgendering in education bill passed committee and has gone to the House floor.
SB164 – a bill to ban gender affirming care for youth under the age of 16. Makes providing such care a felony. Has passed the Senate and been sent to the House.
UTAH:
HB0269 – a student dormitory segregation bill has been signed into law.
HB0252 – had second Senate floor reading. This bill would prohibit the Utah Department of Corrections from starting gender affirming care for incarcerated persons and would deny appropriate housing for incarcerated trans youth.
HB0283 – restricts youth in foster care from receiving gender affirming care, requires outing of a youth’s gender or sexuality to the parent, guardian, or custodian, does not prohibit reuniting a youth with parents if they do not support the youth’s stated or expressed gender.
WYOMING:
SF0103 – prohibits state funding to support DEIA programs, including education or trainings about gender dysphoria. Introduced to committee.
HB0164 – a gender affirming care ban for minors by prohibiting “off-label” use of medications specifically for gender affirming care. Passed House and sent to Senate.
February 13th and 14th: Judges in Maryland and Washington issued temporary restraining orders on the executive order stopping federal funds to institutions or organizations that receive federal funds and provide gender affirming care to youth and young adults under age 19. Both injunctions will last for two weeks, with hearings at the end of those two weeks scheduled to end or continue the injunction. Some hospitals and providers have resumed care while others have not.
February 7, 2024:
The Attorneys General of Washington, Minnesota, and Oregon filed a lawsuit challenging the executive order banning gender affirming care for youth and young adults under age 19 and asking for an injunction. This lawsuit joins a lawsuit filed earlier this week by Marlyand, PFLAG, and GLMA also challenging the executive order.
WA Attorney General Nick Brown’s press conference this morning has some lovely moments. We encourage you to listen starting around the 2:30 mark: “This order is gross. It is disgusting. It is hateful.” It is worth it to listen to entire press conference.

Listening to a press call with @aclu.org and @lambdalegal.bsky.social right now, and the big takeaway: The trans executive order is not immediately enforceable. As federal agencies try to make rules enforcing this order, ACLU and Lambda plan to sue based on the rules, ways those rules are made, etc
Also Lambda Legal senior counsel says if people DO travel with an X passport and run into issues, “We are your lawyers.”

January 17th:
FEDERAL: The Supreme Court of the US has announced that it will hear Mahmoud v. Taylor, a case from Maryland, that argues that public schools violated parental rights to the free exercise of religion when students were not allowed to opt out of LGBTQ+ themed storybooks in primary school. See move via Chris Geidner’s LawDork posts and Wikipedia.
Florida: Florida attorneys argued in the 11th Circuit Court of Appeals that Judge Hinkle ruled incorrectly in June when he declared Florida’s ban on medical care for transgender youth and most of the restrictions on medical care for transgender adults were unconstitutional and blocked the law which restricted care. A three-judge panel stayed that block in August while the state appealed. Restrictions on care are currently in effect in Florida. We do not know when a ruling will be available. Separately, we expect a ruling from the Supreme Court on Tennessee’s youth care ban sometime before July.
January 16th:
FEDERAL – The US House of Representatives passed H.R.734, the bill which would ban trans girls and women from being on girls/women’s teams in sports and athletic programs that receive federal funding. Or, most schools and colleges. The bill also wants to define sex as “based solely on a person’s reproductive biology and genetics at birth,” which we all know is a very poor way of understanding biology, and certainly doesn’t describe gender. As Erin Reed states, “it would mark the first instance in recent U.S. law where transgender individuals are explicitly defined as not legally belonging to the gender with which they identify, as recognized by their identification documents and court rulings.”

January 10th:
FEDERAL – a Kentucky judge has struck down the Biden administration’s expansion of Title IX protections for LGBTQ+ students. These protections had already been suspended in many states, and are now are suspended nationwide. This sucks for all students, not just LGBTQ+. We are not entirely sure what version of Title IX is currently in effect.

FEDERAL – (ACTION) A House hearing is scheduled on Tuesday, January 14th on H.R. 734 “Protection of Women and Girls in Sports Act of 2023”. You can guess. Call your reps and oppose. Sample scripts and some discussion via Bluesky.
CALIFORNIA – GOOD BILL! – State Sen. Scott Wiener introduced the Transgender Privacy Act (SB 59) which would seal court records related to transition, including name, gender, or sex marker changes.
MONTANA – Montana house hearing today on a state-wide bathroom ban in public buildings. Erin Reed is covering live.
IDAHO – Federal judge denies bid to block Idaho’s ban on public funds for gender care. A request for a preliminary injunction has been denied. Idaho state funds (Medicaid) will continue to not cover transgender healthcare such as hormones, puberty blockers, or surgical procedures.

January 7th (ACTIONS):
Washington – WA Senate Bill 5136 has been filed. It is a school name bill requiring staff to use student’s names as they appear on their birth certificates and the pronouns associated with that listed “biological” sex unless written permission is given by the student’s parent(s) or guardian(s). Employees or contractors may not be required to use affirming pronouns if they don’t want to, regardless of youth or parental/guardian wishes.
What to do: go to this link, click on “Send a comment on this bill to your legislators” and tell them that you oppose the bill.
January 6th:
Florida – Content warning: forced detransition.
Erin Reed reports on a ruling by Florida Northern District Judge Allen Winsor rejecting an injunction request on a law removing access to gender care for incarcerated transgender individuals in Florida. Judge Winsor’s ruling stakes the claim that gender care is not necessary medical care. Incarcerated persons have the right to medical care, and this is an unconstitutional ruling.
